In addition to the features that are placed in the highway to aid or protect highway users, such as direction signs, street lights, safety barriers etc, there are also many other objects located in the highway but which are not strictly needed to enable the effective and safe operation of the highway network. Examples include litter bins, benches / seats, works of art, pedestrian directional (fingerpost’) signs and historical monuments.
Many of these features have been located in the highway by District, Town and Parish Councils; indeed, these authorities have the right to place various items in the highway – including trees - on the condition that the County Council has first given its consent.
The responsibility for maintaining litter bins, benches, and signs normally lies with the organisation that placed it there. However, if you are unsure who should maintain a particular feature or if you believe that such an item presents an immediate hazard to road users, you should contact your local Area Highways Team.
If an individual, organisation or other body wishes to place a permanent or temporary feature in the highway – which includes trees or any other plant - they will need to have obtained prior consent from the County Council. This will normally come in the form of a licence. The type of licence and the conditions that may be applied to it will be dependent on the object that is to be placed on the highway, its location, size, construction and whether it is intended to be permanent or temporary. Temporary features such as skips and scaffolds also need to be approved by the County Council before they can be sited on the highway. The County Council's Transport Co-ordination Service also decides, with the Police, on the location of new bus stops or changes to existing stops.
