This page is intended to be used by utility companies and their contractors to assist in the co-ordination of roadworks within Cheshire. The information contained is specific to the implementation of the New Roads and Street Works Act -1991 and Traffic Management Act - 2004 and is not aimed at the general public.
General Information
The New Roads and Street Works Act and Traffic Management Act have put a new emphasis on minimising disruption to the road user. This involves sets of procedures that ensure all works are 'co-ordinated' to minimise possible disruption. The Council is the Highway Authority responsible for the co-ordination of all roadworks on the County's roads.
Section 58 Schedules
Under Section 58 of the New Roads and Street Works Act 1991 (NRSWA), the execution of street works (the work of utility companies) may be restricted (for periods of 6 months, 1 year, 3 years or 5 years respectively depending upon the nature of the roadworks) following the completion of substantial roadworks (the work of the highway authority).
The aim is to provide an opportunity for utility companies to carry out their works either before or during the roadworks and prevent excavation to the newly laid road surface.
The following 3 spreadsheets contain Section 58 Notice information. Subject to the exemptions of the Act and Regulation under it, no street works may be executed for a period of 6 months, 1 year, 3 years or 5 years respectively depending upon the nature of the roadworks from completion of the works described without the written consent of The Council.
